Delivery and Returns

GENERAL TERMS:

  1. By placing an order electronically through the website you are using, you are deemed to have accepted the preliminary information form and the distance sales contract provided to you.

  2. Buyers are subject to the provisions of the Consumer Protection Law No. 6502 and the Distance Contracts Regulation (Official Gazette: 27.11.2014/29188) and other applicable laws regarding the sale and delivery of purchased products.

  3. Shipping fees related to product delivery shall be borne by the buyer.

  4. Each product purchased shall be delivered to the person and/or entity at the address indicated by the buyer, within the legal maximum period of 30 days. If the product is not delivered within this period, the buyer may terminate the contract.

  5. The purchased product must be delivered complete and in accordance with the specifications stated in the order, and with documents such as warranty certificate and user manual, if applicable.

  6. If it becomes impossible to fulfill the order, the seller must inform the buyer within 3 days and refund the total amount within 14 days.

IF PAYMENT IS NOT MADE FOR THE PURCHASED PRODUCT:

  1. If the buyer fails to pay or cancels the payment in bank records, the seller’s obligation to deliver the product ceases.

PURCHASES MADE WITH UNAUTHORIZED USE OF A CREDIT CARD:

  1. If, after delivery, it is determined that the credit card used for payment was used fraudulently by unauthorized persons and the payment is not made to the seller by the relevant bank or financial institution, the buyer is obligated to return the product to the seller within 3 days, with the return shipping cost covered by the seller.

IF DELIVERY CANNOT BE MADE ON TIME DUE TO UNFORESEEN CIRCUMSTANCES:

  1. If unforeseeable force majeure events prevent timely delivery, the buyer will be informed. The buyer may request cancellation of the order, replacement with a similar product, or postpone the delivery until the situation is resolved. If the order is canceled, and the buyer has paid by cash, the amount will be refunded within 14 days. If payment was made by credit card, the refund will be processed to the bank within 14 days, but the bank may transfer the funds to the buyer's account within 2-3 weeks.

BUYER'S OBLIGATION TO INSPECT THE PRODUCT:

  1. Before accepting delivery, the buyer must inspect the goods. Damaged or defective items (e.g. dented, broken, torn packaging) should not be accepted from the shipping company. Accepted items are considered to be in good condition. If the right of withdrawal is to be exercised, the product must not be used and must be returned with its invoice.

RIGHT OF WITHDRAWAL:

  1. The buyer may exercise their right of withdrawal within 14 (fourteen) days from the date of delivery, without providing any justification or incurring any legal or penal liability, by notifying the seller via the contact information provided below.

DURATION OF THE RIGHT OF WITHDRAWAL:

  1. For services, the 14-day period begins from the date the contract is signed. The right of withdrawal cannot be exercised for services that have already commenced with the consumer’s consent before the withdrawal period ends.

  2. The cost arising from the use of the right of withdrawal shall be borne by the seller.

  3. To exercise the right of withdrawal, a written notice must be sent to the seller within 14 (fourteen) days via registered mail, fax, or email, and the product must not fall under the “Non-Returnable Products” as outlined below.

EXERCISING THE RIGHT OF WITHDRAWAL:

  1. The invoice of the product delivered to a third party or the buyer must be returned. (If the invoice is issued to a company, a return invoice issued by the company must be included. Otherwise, returns will not be processed.)

  2. The return form, along with the product’s box, packaging, and any standard accessories, must be sent back undamaged and complete.

RETURN CONDITIONS:

  1. The seller must refund the total amount and all obligations imposed on the buyer within 10 days from the date they receive the withdrawal notification and must collect the returned product within 20 days.

  2. If the product’s value is reduced or return becomes impossible due to the buyer's fault, the buyer must compensate the seller for the damage. However, the buyer is not liable for changes or deterioration caused by proper use within the withdrawal period.

  3. If the withdrawal causes the total amount to fall below a campaign limit, the discount benefit is revoked.

NON-RETURNABLE PRODUCTS:

  1. Products customized at the buyer’s request or clearly tailored for personal needs, underwear bottoms, swimsuits, bikini bottoms, cosmetics, single-use products, perishable goods or those with a short shelf life, products unfit for return due to health or hygiene reasons once opened by the buyer, mixed products that cannot be separated, periodicals like newspapers or magazines (excluding subscriptions), digital services or non-tangible goods delivered instantly online, audio/video recordings, books, software, data storage devices, and computer consumables (e.g. toner, cartridges) that have been opened by the buyer are not eligible for return. Services that have already started with the consumer’s consent before the withdrawal period ends are also excluded.

  2. Cosmetics, personal care products, underwear, swimsuits, books, copyable software and programs, DVDs, VCDs, CDs, cassettes, and stationery supplies (toner, cartridges, ribbons, etc.) can only be returned if unopened, unused, and undamaged.

DEFAULT AND LEGAL CONSEQUENCES:

  1. If the buyer makes payment via credit card and defaults, they agree to pay interest according to the agreement with their bank and to be responsible to the bank. The bank may take legal action and demand expenses and attorney fees from the buyer. In any case, the buyer agrees to compensate the seller for damages due to delayed payment.
