1. Parties

a) STARMAX DESIGN YAPI MALZEMELERİ TİCARET LİMİTED ŞİRKETİ, located at MEHMET AKİF ERSOY MAH. 2133. SK. NO: 31-33, APT NO: 13, ESENYURT/ISTANBUL, which operates the website www.starmaxmicrocement.com (hereinafter referred to as “STARMAX”).

b) The internet user who has registered as a member of the website www.starmaxmicrocement.com (hereinafter referred to as the “Member”).

2. Subject of the Agreement

The subject of this Agreement is to determine the terms and conditions for the Member to benefit from the website www.starmaxmicrocement.com owned by STARMAX.

3. Rights and Obligations of the Parties

3.1. The Member declares and undertakes that the personal and other information provided while registering on www.starmaxmicrocement.com is accurate and lawful, and that they will compensate all damages STARMAX may incur due to the inaccuracy of this information immediately and in full.

3.2. The Member may not share their password provided by STARMAX with any other person or organization. The Member has the sole right to use the password. All responsibilities and consequences arising from such unauthorized use shall rest solely with the Member. STARMAX reserves the right to claim compensation and other legal remedies for any unauthorized use.

3.3. The Member agrees in advance to comply with all applicable laws while using www.starmaxmicrocement.com. Otherwise, the Member accepts full legal and criminal responsibility for any breach.

3.4. The Member agrees not to use www.starmaxmicrocement.com in any way that is against public order, immoral, offensive, harassing, unlawful, or in violation of intellectual and copyright laws. The Member shall also refrain from engaging in any activity (spam, virus, trojan horse, etc.) that would prevent or hinder others from using the service.

3.5. The opinions and comments posted on www.starmaxmicrocement.com by Members represent their own personal views and are not connected in any way to STARMAX. STARMAX shall not be held liable for any damages resulting from these views, whether incurred by other Members or third parties.

3.6. STARMAX shall not be held liable for the unauthorized access to or loss of Member data. The Member agrees not to claim any compensation from STARMAX for any damage they may suffer due to the use of the site.

3.7. The Member agrees not to access or use other users’ software or data without authorization. Legal and criminal liabilities arising from such actions shall solely rest with the Member.

3.8. The Member who violates any of the provisions listed in this membership agreement shall be personally and legally liable and shall indemnify STARMAX against any resulting claims or damages. STARMAX also reserves the right to seek compensation from the Member if legal proceedings arise due to such violations.

3.9. STARMAX reserves the right to unilaterally terminate a Member’s membership and delete their data and files without prior notice. The Member accepts this in advance and shall not hold STARMAX liable in any way.

3.10. The software and design of the website www.starmaxmicrocement.com are the property of STARMAX and protected by copyright and intellectual property laws. They may not be used, acquired, or modified without permission. Other companies and product names mentioned on the website are trademarks of their respective owners and also protected.

3.11. STARMAX may collect certain information such as the name of the Internet service provider used to access the site, the IP address, access date and time, visited pages, and the referring website address, to improve and develop the site and in accordance with legal obligations.

3.12. STARMAX may use Members’ personal information to provide better service, improve its products and services, and customize user experience. STARMAX reserves the right to keep a record of Members’ activities on the site.

3.13. The Member agrees to receive product and service promotions, advertisements, campaigns, surveys, and other customer satisfaction communications via internet, phone, SMS, etc. under current or future practices. The Member accepts not to claim any damages (direct or indirect, material or moral) due to the collection, sharing, use, archiving, or accessing of this information. If the Member wishes to change their data-sharing preferences, they may contact STARMAX customer service.

3.14. STARMAX may disclose the Member’s personal information when legally required or when it believes in good faith that such action is necessary to comply with legal requirements or legal processes served on STARMAX, or to protect and defend the rights or property of STARMAX and its websites.

3.15. Although STARMAX takes reasonable precautions to keep its website free of viruses and similar malicious software, the final security lies with the user. The Member is responsible for providing their own virus protection. By accessing the STARMAX website, the Member accepts responsibility for any errors and consequences that may arise in their software or systems.

3.16. STARMAX reserves the right to change the content of the site, terminate or modify services, or delete user information at any time.

3.17. STARMAX may change, update, or cancel the terms of this membership agreement at any time without prior notice. The updated provisions shall be effective upon publication for all Members.

3.18. The parties agree that all computer records of STARMAX shall be the sole and conclusive evidence in accordance with Article 287 of the Turkish Code of Civil Procedure, and that these records constitute an evidentiary agreement.

3.19. STARMAX is authorized to send informational emails to the email address and SMS messages to the phone number registered by the Member. By approving this agreement, the Member agrees to receive such messages. If the Member wishes to unsubscribe, they may do so in the “Notification Preferences” section under “My Account.”

4. Termination of the Agreement

This Agreement shall remain in force until the Member terminates their membership or STARMAX cancels it. STARMAX reserves the right to unilaterally terminate the membership and this Agreement if the Member breaches any provision of this Agreement.

5. Dispute Resolution

In the event of any dispute arising from this Agreement, the Istanbul Courts and Execution Offices shall have jurisdiction.

6. Enforcement

By registering as a Member, the user confirms they have read and accepted all the terms and conditions of this Agreement. This Agreement is deemed to be concluded and enter into force upon the Member’s registration.
